Statement on speculations about the European Commission’s alleged new investigation into the agreement

17.9.2010

ENERGETICKÝ A PRŮMYSLOVÝ HOLDING (EPH) dismisses the rumours of the European Commission's alleged new investigation into the "secret agreement" between ČEZ, J&T and EnBW as purely self-serving.  The above agreement was published in the Czech media approximately one year ago. The agreement has also been available to the European Commission since last year. The text of this free agreement makes it completely clear that it does not concern the market of products or services, and that it therefore could not result in any distortion of competition.

The current topic, which is attracting media coverage, is only a purely self-serving provocation by Candole, a smaller Prague-based lobbyist agency, which is not specialised in energy and has no reputation in this sector. Some time ago, this company actively offered its lobbying services to us, but we rejected its services. Candole is evidently working for a different customer now.

As regards the European Commission's ongoing procedure, we consider it to be appropriate to note that the European Commission has not raised against EPH any formal objections concerning the operation of Energetický a průmyslový holding on the energy market or other related matters such as, for example, the above agreement, now the focus of self-serving media coverage. The European Commission's ongoing procedure against EPH only concerns some procedural matters related to the procedural mistakes, if any, made by the group's staff during the inspection that took place in November 2009.
