STATEMENT TO THE EUROPEAN COMMISSION’S DECISION TO COMMENCE PROCEEDINGS

We may confirm that the European Commission commenced proceedings with ENERGETICKÝ A PRŮMYSLOVÝ HOLDING for the alleged misconduct during the on-site inspection carried out in November 24 - 26, 2009. ENERGETICKÝ A PRŮMYSLOVÝ HOLDING is ready to defend its position that the employees did no wrong-doing that could have affected the course and/or the outcome of the EC's investigation.

We emphasize that the proceedings commenced by EC relates only to procedural issues that should have been caused by improper conduct by the holdings employees during the course of the inspection. The subject matter of the proceedings therefore does not concern to the conduct and/or position of ENERGETICKÝ A PRŮMYSLOVÝ HOLDING on the market or any related matter. As the text of the EC's decision states, the commencement of the proceedings does not imply that the Commission has conclusive evidence of any misconduct by the employees of ENERGETICKÝ A PRŮMYSLOVÝ HOLDING during the course of the inspection.
